What is Citizenship by Investment

The Dutch Country does not offer a Citizenship-by-Investment program, but it introduced a Golden Visa Program in 2013 with an aim of attracting foreign investors to bring substantial venture capital funding in the country to boost Dutch economy. Through this program, Netherlands offers citizenship after five years of incessant residency.

The prerequisite for residency permit is minimal investment of € 1.25 million in a Dutch Startup Company or a Dutch Venture Capital Fund, which will further invest in the start-ups. The Investment amount needs to be deposited in a Dutch Bank which is subject to further assessed by Netherlands Enterprise Agency (RVO) with respect to Value Addition in the Dutch Economy.

Criteria for Evaluation

Two out of the three following conditions are required to be fulfilled for the purpose of evaluation: –

  • Contributed to the transformation of the Dutch Company by bringing in innovativeness either through any Patent Introduction or through other means like investing in technological or non-technological innovation.
  • At least 10 jobs created in the span of 5 years.
  • Added value although non-financially by the means of specific knowledge, clients, network and a progressive involvement of the Investor.

The Investment amount raised should not be through illegitimate means as the IND (Immigration and Naturalisation Service) has the right to get information from Financial Intelligence Unit- Netherlands regarding origin source of Investment. It should be kept in mind that any incorrect information while applying for the residence permit.

Cost of Application for Netherlands Residence Permit

The application for Residence Permit shall be made with the objective of residence of “Wealthy Foreign National” i.e., foreign investor. The Application fee costs € 2283. If the Investor belongs to San Marino or Israel, the Benelux Treaty exempts you from paying such application fee, or in case you are having Turkish nationality, the application cost shall be only € 69.

Netherlands Residence Permit

The Residence Permit issued stands valid for maximum three years which can be elongated by migration office in Netherlands. The Residence Permit allows you to work freely in the country and it states “arbeid vrij toegestaan – work freely permitted”.

It is not mandatory to live permanently here in Netherlands as the Investors and their family can voluntarily leave the country at their own convenience.

Application Submission and Payment

For travelling to Netherlands, a provisional residence permit (MVV) is required. The mvv is a kind of sticker placed by the Dutch Representations in the passport. An application for the mvv and residence permit can be made erstwhile.

The application can be submitted to the Dutch Representation in the country of origin or country of continuous residence by the foreign investor. That application is forwarded to Immigration and Naturalisation Service (IND) and you will receive a letter from Dutch Representation for the payment of fee.

Receipt and Scrutiny of Application

With the submission of the application at Dutch Embassy is the starting date for processing of your application. The IND is obliged to decide the application within a period of 90 days. Embassy forwards the application to IND and it will scrutinize that application filled is complete in all respects related to documentation (whether they are complete and true and correct), fee payment, and will ask you to rectify in case of any discrepancy in the application.

Decision

After the thorough scrutiny of the application, IND checks if all conditions for application have been duly met or not and accordingly states its decision within 90 days of application. The Residence Permit as well as mvv is issued and IND will inform the Dutch Representation also.

In case, the application gets rejected by the IND, you are eligible to apply for the review of the decision.

Collect MVV

The mvv can be collected from the Dutch Representation where the application form is submitted and it can be collected within 3 months. Do ensure your passport stands valid for at least 6 months on the day you get mvv.

Travel Netherlands

You are allowed to travel to Netherlands once you collected your mvv. The validity of the mvv is 90 days and the mvv sticker shows two dates – Effective Date and End Date.

The mvv allows you to travel the Schengen Area also which consists of various European Countries like Belgium, Denmark (excluding the area of Faroe Isles and Greenland), Germany, Estonia, Finland, France (excluding the area of French Guiana, Guadeloupe, Martinique, Mayotte and La Reunion), Greece, Hungary, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Norway (excluding Spitsbergen), Austria, Poland , Portugal (including the Azores and Madeira), Slovenia, Slovakia, Spain (including the Balearic Islands and the Canary Islands), Czech Republic, Iceland , Sweden and Switzerland.

Post Application – Collect Residence Permit

The IND intends to ready your residence permit within 2 weeks of your arrival in the country. Schedule your appointment with the IND and collect the permit as and when it is ready.

Other Formalities

After arrival in Netherlands, you must register in the Municipal Personal Records Database and undergo a tuberculosis test with the Area Health Authority. Other conditions include rent a flat or housing in Netherlands and a comprehensive health insurance coverage for all family members.
